In this privacy statement “we”, “us” and “our” means Mubasher Capital BSC C and “you”, “your” and “the user” means the individual or an authorized representative of a Corporate entity, who is using this website. In the course of providing financial Products and Services, we need to collect and maintain certain Personal Information.

The following privacy statement explains how we collect and protect your Personal Information. We ensure that any Personal Information obtained from you is not used or disclosed unless we have obtained your consent for such disclosure. By opening an account or by using our website, you give your consent to the collection, use and the disclosure of Personal Information by us in accordance with this privacy statement.

We collect Personal Information from you through our website. You may provide Personal Information to us when you subscribe for any Products or Services or when you fill in account opening applications (whether written or electronic) or provide information in any other form.

We may also collect demographic information when you open an account, including birth date, education, occupation, and information about your intended transactions with us and other information. We also assess your trading experience, your approximate annual income and approximate net worth to assess your financial position and suitability for entering into transactions with us. We will also collect information about transactions you enter into through our website.

We may use the information collected from you to establish and verify your identity and contact information. We will also use this information to establish and set up your trading account, issue an account number and a secure password, monitor your account activity and contact you with account information. This information helps us personalize and continually improve the Services, customize your browsing experience and inform you about additional Products, Services or promotions that may be of interest to you.

We will retain information about you after the closure of the account or if your application is declined or abandoned for as long as we require in order to comply with legal and regulatory requirements and for our legitimate business purposes. We will ordinarily retain your information for ten (10) years or as otherwise required by Bahrain Law.

We may share your Personal Information with our Affiliates and third parties for the purposes of providing you with Products and Services. For example, we may share your personal information in order to process transactions for your account, execute your trades on an exchange, and manage and administer your account or we may share your personal information with any of our service providers as required by them enabling them to provide their services to you. Our Affiliates will deal with your Personal Information in the same way as described in this privacy statement.

We may be obliged to disclose your Personal Information in certain circumstances for legal or regulatory reasons, including but not limited to instances where we are required to disclose the information in accordance with the laws and regulations of the Central Bank of Bahrain.

We may also disclose your Personal Information as necessary to perform credit checks, collect debts, enforce our legal rights or protect our interests and property. By trading with us, you consent to us using and disclosing your Personal Information as set out in this privacy statement.

4. Safety of Personal Information

We have taken appropriate steps to ensure the security of any Personal Information held by us.

A secure http/ communication channel ensures the security of data communications made through our website. Your information is protected during transmission by using Secure Sockets Layer (SSL) software, which encrypts information transmitted to us. Furthermore, a 128 bit key, the most secure form of commercially available encryption, is used to ensure the security of your transactions. We also provide you with a unique user name and password to access your account information online. You are responsible for keeping this password confidential.

We assume no responsibility for loss of whatever nature, howsoever arising and/or resulting from computer viruses, trojans, worms or equivalent or similar items.

Transmission of information via the internet is not completely secure. We have implemented systems and processes to protect your Personal Information, however we cannot guarantee the security of any data transmitted to us via our website; transmission of data is at your own risk.

In accordance with the provisions of the Personal Data Protection (PDPL) Law No. (30) of 2018, you are granted the following rights concerning the processing of your personal data. To exercise these rights under the law, you may be required to provide sufficient proof of identity to authenticate yourself. This ensures the security and privacy of your personal information throughout the process.

2. Right to Enquire

You have the right to request and obtain information regarding the personal data we hold about you, including the purposes for which it is collected, stored, and processed by us.

3. Right to Object 

You have the right to object to being contacted by us for direct marketing purposes. Upon receiving such an objection, we will promptly ensure that your details are removed from the relevant marketing databases, where applicable. 4. Right to Demand Rectification, Blocking, or Erasure 

You may submit a request to rectify, block, or erase your personal data if it has been processed in violation of any legal provisions. This applies particularly if the data is incorrect, incomplete, outdated, or if its processing is unlawful.

5. Right to Withdraw Consent 

You have the right to withdraw your consent at any time after it has been given. The withdrawal will apply to the future use of your personal data and will not affect the lawful processing of your information prior to the withdrawal. However, withdrawing consent for the processing of certain mandatory personal data related to services provided by Mubasher Capital BSC may result in our inability to continue offering those services.

You have the right to file a complaint with the relevant Authority if you believe that a violation of this privacy law has occurred or that we are processing personal data in breach of its provisions.

 

6. Account Closure

Upon a client’s request to close their account, Mubasher Capital will proceed in accordance with applicable laws, regulations, and its User Agreement. To ensure account closure, the client must have no outstanding balance on their account. Mubasher Capital will retain and store the client’s account information, due diligence records, personal data, and any other recorded information, whether electronically, by phone, or through other means, for a period minimum 10 years following account closure. This retention is in compliance with regulations set by the Central Bank of Bahrain (CBB) and ensures that Mubasher Capital can meet legal obligations related to fraud prevention, fee collection, dispute resolution, investigations, and other legal requirements, as well as enforce its User Agreement.

7. Third Parties

Unless otherwise stated in this Privacy Policy, it applies solely to the use and disclosure of client information that is provided to or collected by Mubasher Capital. If the client shares their information with other parties—whether they are Mubasher Capital’s partners or other third parties’ different privacy rules regarding the use and disclosure of that information may apply. Mubasher Capital does not have control over the privacy practices of third parties, and clients will be subject to the privacy policies of those third parties where applicable. Mubasher Capital strongly encourages clients to review and understand the privacy policies of any third parties with whom they share their personal information.

8. Direct Marketing

Subject to applicable laws and regulations, Mubasher Capital may occasionally send direct marketing materials to its clients, promoting its products, services, or activities, using information collected from them. Clients will always be given the option to opt out of receiving such marketing communications. Additionally, Mubasher Capital may request permission from clients to share their personal information with third parties. Clients have the right to opt out of having their personal information shared with third parties or used for any purpose other than that for which it was originally collected and authorized by the client. Please note that if a client chooses to restrict the use of their personal information, certain features or services offered by Mubasher Capital may become unavailable to them.

9. Disputes and Legal Proceedings

Mubasher Capital may need to utilize clients’ personal information to investigate concerns and resolve disputes promptly and efficiently. If a mutual resolution is achievable between Mubasher Capital and the client, the company will work in collaboration with regulators and other relevant authorities to address matters related to the use or disclosure of client information, in compliance with the laws of the Kingdom of Bahrain. Any dispute or claim arising from or concerning Mubasher Capital’s Privacy Policy will be settled according to the terms specified in the User Agreement.

10. Use of cookies

Cookies are small text files sent from the web server to your computer. We use cookies to assist us in securing your trading activities and to enhance the performance of our website. Cookies used by us do not contain any Personal Information nor do they contain account or password information. We do not control or take any responsibility for the use of cookies by third parties.

We give you access, through our website, to Personal Information about your account for the purposes of viewing and in certain cases, updating that Personal Information.

You have the right to obtain copies of records relating to your business with us in accordance with the customer agreement entered between us.
